Legislation Debrief: The Texas Heartbeat Bill

On September 1st, the Texas Heartbeat Bill was put into effect. The Heartbeat Bill prohibits abortions after the detection of a fetus’ heartbeat. According to research conducted by the state of Texas, fetal heartbeat detection is one of the key ways to predict if an embryo will reach birth. However, a heartbeat can only be detected beginning around the sixth week — a time constraint that leaves only a month and a half for a pregnant person to receive an abortion. It typically takes three to four weeks for enough human chorionic gonadotropin, the hormone detected in a pregnancy test, to be produced in an amount suitable for detection. There are no exceptions for rape, incest, or the impregnation of a minor. The only exception to this bill is if there are medical complications with the pregnancy —- for example, a high-risk case in which a patient’s health could be jeopardized by delivery.

In a video from Forbes Breaking News of Texas Governor, Greg Abbott, enacting the Texas Heartbeat Bill, he states that the Texas legislature worked to pass a bill that ensures that the life of every fetus with a heartbeat will be saved from abortion. He also speaks of the right to life for unborn children and the millions lost due to abortion every year. This bill allows any citizen who authorizes, takes part in, or receives a post-heartbeat-detection abortion to be sued for up to $10,000.


In a video from CNBC News, Shepherd Smith interviews lawyer Amy Howe on the relation between the Texas Heartbeat Bill and Roe v. Wade. In this video, she states that the Texas government found a loophole in Roe v. Wade. In most cases, the states enforce the law; however, Texas’ new legislation allows citizens to enforce the laws and, therefore, avoid infringement of Roe v. Wade.
